A follow-up on Bill 122: safety requirements that could be expensive

In December 2010, Bill 122, being the Act amending the Building Act relating mainly to the modernization of the safety requirements, came into effect without leaving the population indifferent. On one hand, let us remember, because this legislation followed upon regrettable accidents which cost the life of two people. On the other hand, because the regulation which was going to follow was likely to bring with it important costs for the owners.

In the first of the incidents, a concrete flagstone was detached from an underground parking, crushing the car of a man and according to the coroner, constructional defects and deficient maintenance were determining.

The common portions for restricted use and the nature of the right of use of a co-owner

In co-ownerships we often hear people say that an element of the building is indicated as being a “common portion for restricted use”. What is this about and who has the right to enjoy it?


First of all, it should be understood that basically, a common portion called “for restricted use”, is located outside the limits of the privative portions described in the declaration of co-ownership and the certificate of localization of the privative portion, as built. Being basically a common portion of the building, all the co-owners are the undivided owners of these portions, meaning that each co-owner of the building is the owner of an undivided share of the whole of the common portions, without being entitled to a right of ownership on a given portion.

PROPERTY DAMAGE IN DIVIDED CO- OWNERSHIPS: co-owners, directors and property managers be wary of water damage!

When property damage is caused to a dwelling it's definitely a source of trouble, inconvenience and a nuisance for the owner. Fortunately, the majority of property owners don't have to face such situations every day.



In divided co-ownership it's the syndicate of co-owners, the members of the Board of Directors, and sometimes the property manager who must react to disasters in order to ensure that repairs are made to the common and private portions of the building affected by the loss. It's the syndicate's duty to take out insurance covering all the usual risks, including fire and damage caused by water. Damage caused by water, originating from either plumbing (sinks, toilets, bathtubs, showers, water line or drain), or natural water infiltration through the building's exterior, results in an important source of damage which can be caused to the building.

MLS® Sales: Record-Setting Month of May for Condominiums

Residential MLS ® sales in the Montréal Census Metropolitan Area (CMA) increased by 13 per cent in May 2012 compared to May 2011, with a total of 4,711 transactions, according to the Greater Montréal Real Estate Board (GMREB). The increase in sales was particularly strong for condominiums, as the 1,484 condominium transactions in May 2012 represent a 14 per cent increase compared to May of last year.

“May 2012 was more than a great month for condominiums; it set an all-time record for the month of May,” said Diane Ménard, Vice-President of the GMREB Board of Directors.

Recently, lawyers have had more and more recourse to what is called the title insurance, but this product still creates confusion. Certain lawyers, in particular in the United States, have recourse to this protection periodically to limit their responsibility because of their system of weak land registration. Although the problems of circulation Montrealers and the inhabitants of the suburbs - who must reach the island to work there - are familiar with, are constantly decried by them, Montreal is ranked 20th concerning the average time spent on its car commuting. Compared to the inhabitants of the region of Toronto (15th in the ranking), who spend on average more than 80 minutes per day to go to and return from their job, the situation in Montreal is less painful than it actually seems.
